Terms & Conditions

These terms apply when you buy an item through allyfrasermakes.co.uk or agree a bespoke commission with Ally Fraser Makes. Please read them before placing an order. Nothing in these terms affects your statutory consumer rights.

1. About Ally Fraser Makes

Ally Fraser Makes designs and makes furniture, sculpture and smaller objects, often using reclaimed, natural or found materials.

2. Products and natural variation

Product photographs and descriptions are intended to show each item as accurately as possible. Colours can appear differently on different screens.

Many pieces use timber, reclaimed materials or found objects. Grain, tone, texture, tool marks, patina, previous use and other variations are part of their character and are not faults where they have been described or would reasonably be expected from the material. Measurements are approximate unless stated otherwise.

Any important requirements, intended use or access restrictions should be discussed before ordering, particularly for furniture, wall-mounted pieces or commissioned work.

3. Prices and VAT

Prices are shown in pounds sterling. Ally Fraser Makes is not VAT registered, so VAT is not added or shown separately.

Delivery to an eligible United Kingdom address is included in the displayed price unless the product page, quotation or order confirmation clearly states otherwise. International delivery is not currently available through the website.

If a pricing or product-description error is discovered before an order is accepted, you will be contacted and given the choice of confirming the order on the corrected terms or cancelling it for a full refund.

4. Orders and payment

Placing an order is an offer to buy. A contract is formed when the order is accepted by email or the item is dispatched, whichever happens first. An automated acknowledgement only confirms that the order has been received.

Payment must be authorised through the payment methods offered at checkout. An order may be declined or cancelled before acceptance if an item is unavailable, payment cannot be authorised, delivery is not reasonably possible or a genuine pricing or description error has occurred. Any payment already taken will be refunded.

5. Delivery

Orders are delivered only to eligible United Kingdom addresses. Delivery may be made by post, courier, a specialist furniture carrier or by prior arrangement, depending on the size and fragility of the piece.

An estimated delivery time will be provided on the product page, during checkout or in the order confirmation where possible. Unless a different period is agreed with you, goods will be delivered without undue delay and within 30 days after the contract is formed.

Please provide complete and accurate delivery details. For large items, you are responsible for checking that there is suitable access through doors, stairs, corridors and other entry points. If delivery cannot be completed because information or access you provided was materially inaccurate, reasonable redelivery costs may be charged after being agreed with you.

The goods remain at Ally Fraser Makes’ risk until they are delivered to you or to a person you nominated to receive them. Please inspect the packaging and item as soon as reasonably possible after delivery and report visible damage promptly. Reporting courier damage within 48 hours is helpful, but does not reduce your statutory rights.

6. Cancelling a standard online-shop order

For standard, non-personalised goods bought online, you normally have the right to cancel without giving a reason from the date of the order until 14 days after the day you receive the goods.

To cancel, send a clear statement by email to allyfrasermakes@gmail.com or use the website contact form. Include your name, order number and enough information to identify the item. You may use the model cancellation wording at the end of these terms, but you do not have to.

After cancelling, you must return the goods within 14 days. Please contact Ally Fraser Makes before sending anything so that the correct return address and safe packing instructions can be provided.

Unless the goods are faulty, damaged or incorrect, you are responsible for the direct cost of returning them. Because some pieces are large, fragile or unique, a tracked and appropriately insured service should be used. You are responsible for any reduction in value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

A refund will be made to the original payment method within 14 days after the returned goods are received or you provide evidence that they were sent back, whichever is earlier. Ally Fraser Makes may withhold the refund until the goods or evidence of return has been received. Standard outbound delivery charges paid by you will also be refunded; where delivery was included, no separate delivery amount is refundable.

7. Bespoke and personalised work

The statutory change-of-mind cancellation right does not normally apply to goods made to your specifications or clearly personalised for you. This includes bespoke commissions once work has begun on the agreed design or materials have been committed specifically to the project.

A commission will normally be governed by a written quotation or proposal describing the design, materials, price, payment schedule, expected timescale, delivery or installation and approval stages. If that document conflicts with these general terms, the specifically agreed commission terms take priority.

Requested changes after approval may affect the price and completion date. No additional charge will be made without your agreement. Any cancellation rights, deposit arrangements and costs for work already performed will be explained before the commission is accepted.

The personalised-goods exception does not affect your rights where an item is faulty, not as described or not made with reasonable care and skill.

8. Faulty, damaged or incorrect goods

Goods must be as described, of satisfactory quality and fit for any purpose made known and accepted before purchase. Services must be carried out with reasonable care and skill.

If an item is faulty, damaged on delivery, incorrect or not as described, contact Ally Fraser Makes as soon as possible with your order number, a description of the problem and photographs where helpful. Depending on the circumstances and your legal rights, the remedy may be a repair, replacement, price reduction or refund. Reasonable return costs for faulty, damaged or incorrect goods will be covered.

Any request to report delivery damage promptly is intended to help with courier claims and does not replace or limit your statutory rights.

9. Returns condition

Change-of-mind returns should be unused and, where reasonably possible, safely packed in their original packaging. You may inspect an item as you would in a shop, but a deduction may be made from the refund if unnecessary handling has reduced its value.

Custom-made goods cannot be returned merely because you change your mind, as explained above.

10. Ownership and intellectual property

Ownership of a purchased item passes to you once full payment has been received and the item has been delivered.

All copyright and other intellectual-property rights in the website, photographs, drawings, designs and original creative work remain with their existing owner. Buying an item does not transfer the right to reproduce its design or use website content commercially.

Unless confidentiality has been agreed in writing, Ally Fraser Makes may photograph completed work and use those photographs for a portfolio, website or social media, provided personal information about the customer is not disclosed without permission.

11. Liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or your statutory consumer rights.

Ally Fraser Makes is responsible for losses that are a foreseeable result of breaching the contract or failing to use reasonable care and skill. Liability is not accepted for losses that were not reasonably foreseeable when the contract was made, or for business losses where you are buying wholly or mainly for personal use.

You are responsible for following any care, installation, weight-limit or safety instructions supplied with an item. This does not exclude responsibility for an item that was unsafe or faulty when supplied.

12. Events outside reasonable control

There may be delays caused by events outside reasonable control, such as severe weather, transport disruption, illness, material shortages or courier failure. You will be contacted as soon as reasonably possible and reasonable steps will be taken to minimise the delay. Your legal rights, including rights relating to seriously delayed delivery, remain unaffected.

13. Personal information

Personal information is handled as described in the Ally Fraser Makes Privacy Policy.

14. Complaints

If something goes wrong, please contact allyfrasermakes@gmail.com so the issue can be addressed promptly. These terms do not prevent you from using any statutory complaint or dispute-resolution route available to you.

15. Governing law

These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you also retain the benefit of any mandatory protections that apply there and may bring proceedings in your local courts. Otherwise, the courts of England and Wales will have jurisdiction.
